01.Acceptance of Terms
By accessing or using our services, you agree to these Terms. You represent and warrant that you are at least 18 years old and have authority to bind your business or organization to this agreement.
02.Description of Service
- AI-powered receptionist, call handling, lead qualification, and communication workflows.
- Appointment booking integrations and calendar-based scheduling automation.
- CRM and third-party business tool integrations for operational workflows.
- Service is designed for continuous operation (24/7), subject to maintenance windows and uptime targets.
03.Account Responsibilities
- You must provide accurate, current, and complete account information.
- You are responsible for account credentials, security settings, and actions taken through your account.
- Each business is generally limited to one account unless otherwise agreed in writing.
- We may suspend or restrict access for violations of these Terms, suspected abuse, or security risk.
04.Acceptable Use
You agree to use the service only in accordance with applicable laws and regulations.
- No illegal, deceptive, fraudulent, or unauthorized use.
- No attempt to reverse engineer, copy, disrupt, or otherwise misuse the platform or models.
- No abusive API usage, automated abuse, or deliberate rate-limit circumvention.
- You must disclose AI call handling to callers where required by federal, state, or local law.
AI and Call Handling Disclosures
Better Service AI uses advanced large language models and synthetic voice systems to interact with callers. Depending on jurisdiction, callers may need notice that an automated AI system is handling the call.
You are responsible for compliance with the Telephone Consumer Protection Act (TCPA) and applicable telemarketing, consent, and privacy laws.
05.Fees and Payment
- Subscription fees are billed monthly based on your selected plan.
- Usage overages are billed at the agreed rate of $0.35 per minute, unless otherwise stated in your order terms.
- Payments are processed via Stripe.
- Subscriptions renew automatically unless canceled in accordance with these Terms.
- Cancellation requires 30 days' notice before the next renewal period.
- No refunds are issued for partial billing periods.
- One-time setup and onboarding fees are non-refundable.
06.Service Level
- Target uptime is 99.5% per calendar month, excluding scheduled maintenance and force majeure events.
- Planned maintenance will generally be communicated with at least 24 hours' notice.
- We are not liable for outages or failures caused by third-party providers or client-side systems.
- Support requests are handled on a best-effort basis, with an initial response target within 24 hours.
07.Data and Privacy
- Use of personal information is governed by our Privacy Policy.
- You retain ownership of your business data and provided content.
- We process client data as a service provider or processor for service delivery purposes.
- Data export and portability are available upon request in reasonable formats.
- Upon termination, eligible data is deleted within 30 days, subject to legal retention obligations.
08.Intellectual Property
- We retain all rights, title, and interest in the platform, software, AI models, documentation, and related technology.
- You retain ownership of your proprietary business data, customer content, and submitted materials.
- Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the service during your active subscription term.
09.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Better Service AI and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, revenue, goodwill, or data.
- Total aggregate liability for all claims is limited to amounts paid by you for the service during the 12 months preceding the event giving rise to liability.
- The service is provided on an "as is" basis with respect to AI-generated outputs and automated decisions.
- We are not responsible for booking, routing, or scheduling errors caused by AI interpretation, third-party integrations, or inaccurate client-provided configurations.
- You are responsible for reviewing and verifying critical business information.
10.Indemnification
- By Client: You agree to defend, indemnify, and hold harmless Better Service AI from claims, losses, liabilities, and expenses arising from your use of the service, violation of law, or breach of these Terms.
- By Better Service AI: We will defend and indemnify you against third-party claims alleging that the core service infringes a valid U.S. intellectual property right, subject to customary exclusions and your cooperation.
11.Termination
- Either party may terminate this agreement with 30 days' written notice.
- Either party may terminate immediately for material breach if not cured within a reasonable cure period, or immediately where cure is not possible.
- You may request data export for up to 30 days following termination.
12.Dispute Resolution
- These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
- Before formal proceedings, the parties agree to a 30-day informal resolution period after written notice of dispute.
- Unresolved disputes will be settled by binding arbitration in Miami, Florida, except where injunctive relief is permitted by law.
13.Modifications
We may update these Terms from time to time. We will provide at least 30 days' notice for material changes, including notice by email. Continued use of the services after the effective date of revised Terms constitutes acceptance.
